Terms and Conditions

1. THE PROMOTER:

2. REGISTRATION

2.1 To qualify to enter the competition the Entrants must register their details on the bestballgolf website, or the link from their Club website to the bestballgolf website.

3. MONTHLY COMPETITION ENTRY

3.1 Each competition will commence on the 1st day of each month (the 'Start Date') and end on the last day of each month at 23.59 Greenwich Mean Time (the 'End Date').

4. ELIGIBILITY

4.1 This competition is open to all residents in United Kingdom and Ireland aged 18 and over as at the Start Date, except those who at any time between the Start Date and the date on which the winner is selected (inclusive) are employees of the Promoter and of its wholly owned subsidiaries or any marketing services agency, handling house or other company involved directly with the administration of this competition, or any member of their immediate family.

5. LEGALITY

5.1 Each and every person who enters the competition (the 'Entrant') warrants and declares that:
(a) they have read and understood these rules and to be bound by them and by any other requirements set out in any related promotional material; and
(b) that by entering this competition online he is not breaching any laws in his country of residence.
(c) It is agreed and declared by the parties that the Promoter will not be held responsible for any entrant entering any of our competitions unlawfully.

6. WINNER ANNOUNCEMENT

6.1 The winner will be notified to the specific Golf Club within 10 days of the closing date of the relevant competition. The result of the competition will be retained for up to 24 months on the Website

7. WINNING THE MONTHLY GAME

7.1 There will be one winning entry per Club each month.
7.2 The winning Entrants will be the entries that have:
(a) used all the information shown in the golf shot photograph displayed on the computer screen (from which the original ball has been permanently erased) and their skill and judgement to correctly identify the area where they consider the judge will decide is the most likely position of the centre of the ball
(b) positioned a 'x' at the closest point to the centre of the ball as determined by an independent judge, being a golfing expert appointed by the Promoter, in the presence of an independent party and a representative from the Promoter; and
(c) answered the question correctly using their golfing knowledge.
(d) received a confirmatory email confirming their entry details to the email address they provided at registration.
7.3 1st place will be the closest. An individual can only win 1st place.
7.4 In the event of a tie, the joint winners will be asked to take part in another “spot the ball” competition so that we can determine the winner.
7.5 The entry mechanism will be exactly the same as before but with a new golf photograph. The competition will be judged in exactly the same way to determine the winner.
7.6 In the event there is another tie the process will be repeated until there is one winner.
7.7 All decisions of the judge will be final and binding on the competitors and no correspondence will be entered into.
7.8 The winning entrant will receive a prize from the Club at which he entered the prize competition.

8. COMPLIANCE

8.1 The winner may be required to show proof of identification to the Club to confirm their identity, address and age before any prize will be paid or delivered. On receipt and verification of the details above, the winner will be awarded the prize.

9. WINNER PUBLICITY

9.1 Entrants accept that, if they win, the Promoter will have the right, without additional payment of permission, to use their name, age, town of residence, Golf Club or Society name, voice recording, photograph and likeness for the purposes of announcing the winner of this competition and for related promotional purposes.
9.2 The Entrant agrees to use best endeavours to ensure that any Golf Club the Entrant is a member of and who benefits from any competition run by the Promoter will allow the Promoter to use its facilities for promotional purposes, both immediately after their win and at any time in the future.

10. CANCELLATION

10.1The Promoter reserves the right to cancel any competition, for any reason, before the designated closing date. In these circumstances the Promoter reserves the right to transfer any entry into another competition. The Promoter also reserves the right at its sole discretion to extend the closing date on any time limited competition.

11. EXCLUSION OF LIABILITY

11.1 Liability is excluded to the fullest extent permitted by the law. Nothing in this clause excludes the liability of the Promoter for death or personal injury.
11.2 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes.

12. ELECTRONIC TRANSMISSION

12.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.

13. DATA PROTECTION:

13.1 All competitors are automatically entered onto the Promoters database for the purpose of conveying information as to the status of the competition, as well as for any future promotions, competitions or deals offered by Promoter. 1
13.2 Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter
(a) to administer the competition; and
(b) to contact you about other competitions or about other goods and services which the Promoter considers may be of interest to you.
13.3 Please write to us if you specifically do not want to receive this information at the address listed in Rule ‎15 or email us at info@bestballgolf.co.uk.
13.4 In order to process, record and use your personal data the Promoter may disclose it to:
(a) any credit card company whose name you give;
(b) any organisation (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you;
(c) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you;
(d) any person to whom the Promoter proposes to transfer its business or any part of it;
(e) comply with any legal or regulatory requirement of the Promoter in any country; and
(f) prevent, detect or prosecute fraud and other crime.
13.5 In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

14. GOVERNING LAW

14.1 The competition is governed by Northern Irish Law and any matters relating to the competition will be resolved under Northern Irish Law and the Courts of Northern Ireland shall have exclusive jurisdiction.

15. THE CLUB

15.1 Upon registration the Golf Club agrees to enter into a contact with Bestballgolf for a minimum period of 12 months. During this period there will be a minimum charge of £50 per month to the Golf Club, payable by standing order. Any amounts over this will be invoiced to the Golf Club by Bestballgolf within 1 week of the closing date of the competition and payable within 1 week of receipt. Failure to comply with these conditions may result in Bestballgolf removing the facility to play the prize competition from the Golf Club.
